1. Parties
These Terms & Conditions (“Agreement”) apply to guests (renters) and property owners/hosts who list furnished apartments or villas (“Properties”) through CinciRent. By using our website, booking a stay, or listing a Property, both guests and hosts agree to these terms.
2. Scope of Service
- CinciRent provides an online platform connecting guests seeking long-stay furnished accommodations in Cincinnati, Ohio, with hosts/property owners.
- Guests contract directly (or via CinciRent) to rent a Property for a specified stay period.
- Hosts/property owners list their Properties and agree to provide the Property in accordance with these terms and applicable law.
3. Booking & Payment
- Guests must pay the agreed rental amount, any deposit, and any additional fees (e.g., cleaning, pet fees).
- Hosts agree to deliver the Property as listed (furnished, in good condition, ready for occupancy).
- All payments must comply with applicable payment processing protocols and any specified cancellation rules.
4. Minimum Stay & Stay Duration
- Unless otherwise stated in the listing, the minimum stay is [e.g., 2 weeks].
- Extensions beyond the initial stay must be agreed in writing with the host and through CinciRent as required.
5. Hosts/Property Owners – Duties & Responsibilities
Under Ohio law (ORC 5321.04) the host/property owner must:
- Keep the Property compliant with all applicable housing, health, building and safety codes. (Ohio Laws)
- Maintain in safe, sanitary and good working condition the plumbing, heating, sanitation, electrical systems, and appliances they supply. (Ohio Laws)
- Provide running water, hot water and heat as required unless the Property is exempt. (Ohio Laws)
- Provide the name and address of the Property owner and any agent in the rental agreement (or written notice) as required by ORC 5321.18. (Ohio Laws)
6. Guests – Duties & Responsibilities
Under ORC 5321.05 the guest must:
- Keep their portion of the Property safe and sanitary, dispose of waste properly, keep fixtures clean, and operate utilities properly. (Ohio Laws)
- Not intentionally or negligently damage the Property or allow other persons on the Property (by guest’s consent) to damage it. (Ohio Laws)
- Conduct themselves and their invited persons so as not to disturb neighbours’ peaceful enjoyment of the Property. (Ohio Laws)
- Allow the host/owner reasonable access for inspection, repairs, improvements or showings, in accordance with the Agreement and applicable notice rules.
7. Prohibited Terms & Legal Compliance
- Any term in a rental agreement that conflicts with Chapter 5321 or other applicable law is void. (Ohio Laws)
- For example: a warrant of attorney to confess judgment, or an agreement to waive landlord’s liability under the law, is not valid. (Ohio Laws)
8. Security Deposit & Fees
- If a security deposit is collected, the terms must comply with Ohio law. This includes proper handling of the deposit, interest when required, and timely return or itemized deductions. (TurboTenant)
- Additional fees (cleaning, pets, utilities) must be clearly disclosed in the listing and the Booking Agreement.
9. Cancellation & Termination
- Guests must follow the cancellation terms disclosed in the listing and Booking Agreement.
- Hosts reserve the right to terminate the stay for non-payment, material violation of the terms, or illegal conduct — subject to lawful process.
- Guests or hosts may end a month-to-month tenancy with at least 30 days’ notice; for week-to-week tenancies at least 7 days’ notice, unless otherwise agreed. (Azibo)
10. Property Listing & Host Platform Use
- Hosts agree to list accurate information about the Property (location, furnishings, amenities, policies) and update availability promptly.
- CinciRent may promote hosts and Properties via digital marketing and social media. Hosts grant CinciRent the right to use listing photos and promotional content.
11. Liability & Indemnification
- Guests agree to use the Property responsibly; host/property owner is responsible for compliance with laws and Property condition.
- Hosts indemnify CinciRent and guests against claims arising from host’s non-compliance or misrepresentation of the Property.
- Disclaimer: CinciRent is a referral/marketing platform and not the direct landlord; hosts are responsible for the Property operation unless otherwise agreed in writing.
12. Data & Privacy
- Both hosts and guests must consent to the collection and processing of personal data via the CinciRent platform. Use and handling of personal information are governed by the CinciRent Privacy Policy.
13. Dispute Resolution & Governing Law
- This Agreement is governed by the laws of the State of Ohio.
- Any dispute arising out of this Agreement shall be resolved by negotiation and, if needed, escalated to arbitration or litigation in Ohio courts.
- Nothing herein limits any rights or remedies available under Ohio law (e.g., ORC 5321) which cannot be waived.
14. Amendments
- CinciRent reserves the right to modify these Terms & Conditions. Notice of material changes will be provided. Continued use of the platform after changes constitutes acceptance.
15. Miscellaneous
- If any provision of this Agreement is found to be invalid or unenforceable under Ohio law, the remaining provisions will continue in full force and effect.
- This Agreement, along with the Booking Agreement and host listing agreement, constitutes the full understanding between the parties regarding the rental relationship.
